ICE threatens at-large arrests after California passes sanctuary city law

The U.S. Immigration and Customs Enforcement agency’s recent raids targeted immigrants in sanctuary cities in a four-day operation

California's governor, Democrat Jerry Brown, signed the landmark legislation - Senate Bill 54 (SB54) - which grants better protections to people who are in the USA without permission, including those who have committed crimes.

Brown to take a step back from a bill the administration feels goes too far. He called the legislation a balanced measure that would allow police and sheriff's agencies to continue targeting risky criminals, while protecting hardworking families without legal residency in the country. The law, in part, strictly limits local law enforcement agencies' collaboration with Immigration and Customs Enforcement (ICE) agency officials to only conviction cases and not during arrests.

This misguided legislation will severely undermine those efforts.

Additionally, officers will be prohibited from arresting an individual exclusively based on a civil immigration warrant, becoming deputized as immigration agents, or participating in joint task forces with the federal government if the primary goal is immigration enforcement.

Still, SB54 is the right move for California. The political intimidation tactics are starting to work too, with sanctuary city politicians questioning whether half-measure legal protections are worth risking expanded federal invasion in local communities.

Assembly Bill 540, by Assemblyman David Chiu, D-San Francisco, forbids employers from sharing personal information with federal agents about employees or granting immigration officers access to workplaces without proper court orders.


Homan's statement was immediately blasted by the bill's author, Senate Pro Tem Kevin de León, as more "fear-mongering" by the Trump administration, but it raised serious questions about whether it signaled a shift in ICE tactics - and what such a shift might look like. Research has shown sanctuary cities have lower crime rates and that immigrants generally commit fewer crimes than US citizens. It was the centerpiece of this year's legislative proposals in Sacramento that sought to challenge Trump's stance on illegal immigration and provide protections for families amid his threats of mass deportations.

SB54 will negatively impact ICE operations in California by almost eliminating all cooperation and communication with our law enforcement partners in the state, voiding the delegated authority that the Orange County Sheriff's Office has under the 287g program, and prohibiting local law enforcement from contracting with the federal government to house detainees.

It prevents immigrants from being delivered to Immigration and Customs Enforcement (ICE) officers unless they are convicted of certain felonies and misdemeanors.

The legislation calls for the California Attorney General to publish model policies limiting assistance with immigration enforcement to the "fullest extent possible", according to the text. "They are free to use their own considerable resources to enforce federal immigration law in California".

The new law doesn't specify what happens if local law enforcement agencies don't comply with the new rules. Already illegal immigrants have been granted drivers licenses.

For other officers, though, the legislation would set new guidelines and has long divided police chiefs and sheriffs. His bill will aid the California National Guard to help its members who are undocumented gain citizenship.
