A USA mother who accidentally smothered her newborn son as she slept is suing the hospital where his death occurred for $8.6m (£6.6m).

According to TIME, Portland Adventist Medical Center spokeswoman Kristi Spurgeon Johnson said she could not comment on the allegations or lawsuit until the hospital had reviewed to matter.

Now, five years later and the mother of a healthy toddler, Monica is seeking justice for herself - and for Jacob.

That night, the hospital gave Thompson a "combination of narcotic pain killers and sleep aids" around midnight, with a nurse returning to her room with Jacob around 3 a.m.

A nurse later arrived and called a "code blue" as Jacob was not breathing, the suit says. She tried to wake him up while calling for a nurse for help.

Just three days after Jacob Thompson was born, he suffocated and was left with severe, permanent brain damage.

The suit seeks damages for the baby's "desperation and anxiety" as he was suffocated and his mother's "severe emotional distress upon unintentionally killing her firstborn child".

A new mother is suing a United States maternity hospital for $14 million after she rolled on her new baby and smothered him in her sleep. "What happened to us could have easily been prevented had the nurses been doing their job", Thompson said in a statement through her lawyer.

Thompson, who is suing both the hospital and the individual nurse involved in the incident, said she was "still drowsy and groggy" from her medication when she realized her son was not moving, her lawsuit states.

Due to the extensive lack of oxygen the baby boy endured, he suffered significant brain damage, the Daily Mail reports.

The hospital has released a statement, as well, noting, "This was a tragic event and our thoughts and prayers continue to be with the family". Mrs. Thompson tried to stimulate her son's suckling reflexes without success. She's also asking for another $100,000 for medical and counseling expenses. "Adventist Medical Center is committed to providing quality, compassionate care to all of our patients".

Though Jacob was stabilized, he never regained consciousness and put on life support in the neonatal intensive care unit.

Tragically Jacob's death came after the Thompsons struggled with infertility for 12 years before they became pregnant with Jacob in 2012. She said they were unable to provide any additional information at the time.

The American Academy of Pediatrics recommends that babies are put to sleep on their back for every sleep, whether it's a nap or at night time. [They] left the room and left mother and son unattended.
